PRIVACY POLICY

Elite International PR Ltd (hereafter referred to as “Elite International”, EI or “Elite“we”, “us” and “our”) a company registered in England and Wales (company number: 12597865) who’s registered address is at: 130 Old Street, London, EC1V 9BD

IMPORTANT: ELITE INTERNATIONAL PR LTD are NOT a travel agent and are NOT the Clinic, hospital and/or the doctor, nurse, practitioner and are not offering any medical services.

EI are brokers, mediators and coordinators of medical and logistic services (hereby referred to as “The Service Provider”) to consumers (hereby referred to as “The Client”.) You will be entering into contracts/agreement DIRECTLY with The Service Providers coordinated by Us.

The Client hereby warrants, undertakes and accepts by signing this Agreement that EI are not liable for any loss or damage or any other claim whatsoever against EI or their staff or representatives in the event that The Service Provider fails to deliver the agreed services or terms & conditions or contract.

These terms & Conditions will inform you who we are, how we will coordinate the services of The Service Provider to you, how either of us may change or end the agreement, what to do if there is a problem, and other important information.

We intend to rely on the terms set out herein and your booking details. If you require any changes, please make sure you ask for them to be put in writing. This can help to avoid any problems relating to what you expect from us and what we expect from you.

It is your responsibility to ensure that you are contactable on the contact details provided. The following terms and conditions will outline the brokering and coordination services that we shall provide.

1. DEFINITIONS
1.1 The following definitions and rules of interpretation apply in theseterms:

Booking - a booking for a Cosmetic Procedure and/or associated services such as transport and accommodation;

Business Day - a day other than a Saturday, Sunday or public holiday in your country of residence

Client Consent Form - the person who is receiving the contracted services of The Service Provider and the Clinic/Surgeon

Consultation - the hospital consent form which is sent to you via email regarding your booking, between you and the Surgeon/Clinic, and/or the face-to-faceconsultation between you and the Surgeon/Clinic in relation to your Cosmetic Procedure;

Cosmetic Procedure(s) - the cosmetic procedure(s) as agreed with the Surgeon/Clinic either before or varied by mutual agreement and for which you Consented with the Service provider

Cosmetic Procedure(s) date - the date of the Cosmetic Procedure(s)

Departure Date - the end date of your stay;

Departure Point - the departure lounge of the relevant airport from which you will depart (if applicable)

Fees - the charges which are payable by you in accordance with The Service Provider

Accommodation - the property which you will attend during your stay;

your nominated point of contact during your stay;

Start Date - the date on which you arrive;

Surgeon/Clinic Stay - the surgeon or clinic who will undertake your Cosmetic Procedure;


Service Provider
- the business that provides the associated services such as accommodation and/or travel for the Client

1.2 Interpretation:

1.2.1  A reference to a statute or statutory provision is a reference to it as amended or re-enacted. A reference to a statute or statutory provision includes all subordinate legislation made under that statute or statutory provision.

1.2.2  A reference to a person includes a human individual, a corporate entity and any organisation which is managed or controlled as a unit.

1.2.3  Any agreement by any party not to do or omit to do something includes an obligationnot to allow some other person to do or omit to do that same thing.

1.2.4  Any words following the terms including, include, in particular, for example or any similar expression, shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.

1.2.5  A reference to writing or written includes fax, messaging and email.

1.3 Our role is to facilitate the introduction of the Surgeon/Clinic to you for the purposes of the undertaking the Cosmetic Procedure(s) and to coordinate the accommodation, transport and other services and facilitate a comfortable stay.

1.4 We will coordinate, mediate and broker the services of Service Providers as well as:

1.4.1  a person able to communicate in English and the local language to accompany you to appointments with the Surgeon/Clinic during your stay; and

1.4.2  access to English speaking staff during your stay via the Service Provider.

2. Before you travel

2.1 You must provide us with the following:

2.1.1  a copy of any prescriptions you have which sets out any medication that you require and/or are currently taking, and any instructions issued by your doctor;

2.1.2  if requested, confirmation of travel and other insurance that you have taken out to cover your travel, Cosmetic Procedure(s) and aftercare;

2.1.3  emergency contact details and those of your next of kin. Please note that in the event that your procedure is not carried out in an EU destination the European Health Scheme is not applicable;

2.1.4  you must disclose your medical information to the Surgeon/Clinic (or otherwise outside the UK or country of residence), forthepurposes of your stay and Cosmetic Procedure; and

2.1.5  your inbound and outbound flight details, along with passport information and if any visa is required by the immigration department of the receiving country our inbound and outbound flight details,

3. Booking your Cosmetic Procedure(s) and stay

3.1.1 Once the Surgeon/Clinic have received your deposit and your flight information, Wewill send you an email confirmation of your booking.

You are required to provide to us with:

3.2.1 your personal details;

3.2.2 any special requests (which we will try to accommodate with the Service Provider);

3.2.3 details of any allergies and/or pre-existing medical conditions;

3.3 IMPORTANT – If you do not provide us with this information within such timescales, or if you provide incomplete or incorrect

information, then you may be responsible for any financial damages or losses that occur as a result.

3.4 The Surgeon/Clinic will be a qualified medical practitioner who is registered and qualified in their field but EI cannot be held liable for any issues relating to this.

3.5 Please note that all surgery, including Cosmetic Procedure(s), carries a risk to life andhealth, and the results of some aspects of Cosmetic Procedure(s) are subjective and are not guaranteed. A full list of risks associated with your Cosmetic Procedure(s) will be emailed to you by us and/or the Clinic and in any case in advance of the procedure. You accept, declare and undertake that EI has no responsibility regarding the performance of the Cosmetic Procedure(s), including but not limited to anesthesia and surgery. You acknowledge and agree that EI is a broker/coordinator of Cosmetic Procedures and the Service Provider only and does not hold itself out as being medically trained or providing any medical care, advice or treatments or package holiday provider. Any advice or information provided relating to Cosmetic Procedure(s) are provided by the Surgeon/Clinic.

4. Payment

4.1 ALL PAYMENTS are made directly to EI. We take all reasonable care to ensure that the Service Provider Fees charged to you are correct but you hereby agree that EI are not responsible or liable for any dispute that may derive from the performance of th e Surgeon/Clinic contract or The Service Provider.

It is always possible that, despite our best efforts, some of the prices of the CosmeticProcedures andPackages may be subject to change due to your requirements or other factors beyond our control (including but not limited to currency fluctuations) and EI cannot guarantee the price. We recommend that the Client will confirm the Fees before accepting your booking

4.2 If you believe that there is an error on an invoice issued by the Service provider, please contact us promptly to let us know and we will mediate with the Surgeon/Clinic or Service provider

5. Changes and cancellations by you

5.1 We will try to coordinate any reasonable changes that you wish to make to your itinerary, provided you give us reasonable notice ahead of time. If we are able to accommodate such changes, we will let you know if this is possible and inform you of anything else including costs which would be necessary as a result of your requested change. You are required to confirm in writing whether you wish to go ahead with the change. You accept and declare in advance that EI has no liability or responsibility in the event of any changes.

5.2  Please note that the Contract is completed when we have finished providing you the agreed service Package as set out in your booking confirmation.

5.3  Only the person who made the booking for the stay may cancel (except in the event of death, serious illness or injury of that person, in which case the next of kin previously notified to us, may cancel the booking on production of satisfactory evidence of such death or incapacity).

5.4  In the event that circumstances beyond our control force you to shorten or extend your stay, please note that you will be liable for any additional costs, services and work incurred by us during your stay, provided that such additional costs are reasonably and necessarily incurred.

5.5  As the purpose of the stay is to undertake your exclusive Cosmetic Procedure(s) service, therefore it is not possible to transfer your booking to another person.

5.6  EI cancellation policy if you choose to cancel the booking, the following fees will apply:

• The deposit is non-refundable

• If you cancelled between 14-3 working days before the Booking: 30% of the total Fee

• If you cancel from 2 working days before the Booking: 50% of the total Fee

• If you cancel on the day of the Booking: 80% of the total Fee

6. Changes and cancellation by us

6.1  If your Cosmetic Procedure or related services is delayed by an event outside our control or of the Service Provider, we will

contact you as soon as reasonably possible to let you know and will take steps to minimize the effect of the delay.

6.2  The Surgeon/Clinic may make changes to the Cosmetic Procedure(s) to reflect changes in relevant laws and regulatory requirements and you hereby agree that EI are not liable for any such changes. We or the Service Provider shall tell you about small changes which do not significantly alter the information we have given you about your stay or your Package before the Cosmetic Procedure(s) date.

6.3  If we think a necessary change is important and it materially changes the information we have given you about your stay or your Package, we or the Service Provider will tell you about it as soonas possible, and give you the opportunity to either accept the change, take an alternative Cosmetic Procedure(s) date (paying or receiving a refund / credit in respect of any price difference), or cancel and accept a full refund – this will be mediated and coordinated on your behalf with the Surgeon/Clinic or The Service Provider.

6.4  If such changes occur during your stay, we coordinate and attempt to make alternative arrangements so as to comply as closely as possible with the description in your itinerary and the Package.

6.5  If a problem occurs which is so serious that we have to cancel Cosmetic Procedure(s) before the Departure Date, you may choose to accept either an alternative Cosmetic Procedure(s) date (paying or receiving a refund/credit in respect of any price difference in the Package) or a full refund of all money paid - this will be mediated and coordinated on your behalf with the Surgeon/Clinic or The Service Provider.

7. Travel Insurance

7.1 It is your responsibility to ensure that you obtain sufficient travel insurance which provides you with adequate insurance cover particularly in relation to the Cosmetic Procedure(s). We strongly advise you to obtain sufficient insurance cover prior to your trip (including appropriate travel insurance and any other insurance you consider necessary). This should cover the cost of any cancellation by you and the cost of assistance. It is your responsibility to satisfy yourself as to the extent and adequacy of your insurance cover. We are under no obligation to cover any additional costs or expenses which may arise during your trip except the services listed under Package, including any costs or expenses which would ordinarily be covered by your insurance.

8. Passport, Visa, Covid-19 and Health Requirements

8.1 Please carefully note the following:

8.1.1  you must ensure that your passport is valid for at least 6 (six) months after the proposed Departure Date;

8.1.2  you must apply for anynecessary visa within good time and follow the most recent Covid-19 rules for your Booking.

8.1.3 it is your responsibility to obtain a visa, if required, and follow the correct COVID-19 requirements at the time of your travel. Booking. If unsure of the requirements for your booking please get in touch with your Patient-Coordinator at least 30 (thirty days) days before your Booking.

8.1.4  in the event that you are not accepted into the country or in the event of deportation, the cancellation provisions of these terms and conditions will apply, in particular any loss of actual loss incurred by EI.

8.1.5  you must check with your doctor whether any vaccinations and/or medication is required and allow plenty of time to obtain this. Details are also available from theNational Travel Health Network and Centre http://www.nathnac.org/;

8.1.6  if you require emergency professional medical care during your stay, we will try to coordinate this with the Surgeon/Clinic and inform your travel insurers and next of kin as quickly as possible:

9. Travel Details

9.1 At least 2(two) weeks before the start date, we will confirm all details relating to your stay via the Service Provider, even if they have done so due to their contractual obligations with you.

10. Responsibility for loss or damage

10.1  If we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our failure to perform our responsibilities.

10.2  You accept, declare, and undertake that EI has no responsibility regarding the performance of the Service Provider or Cosmetic Procedure(s), including but not limited to anesthesia and surgery. You acknowledge and agree that EI acts solely as a broker and coordinator of Cosmetic Procedures and does not represent itself as medically trained or as providing any medical care, advice, treatments, or travel agency services. Any advice or information relating to Cosmetic Procedure(s) is provided by the Surgeon/Clinic and is relayed by EI to the Client only as communicated by the Surgeon/Clinic.

10.3  Whilst we will always do our best to assist you with any problems which you may encounter, we are not liable for any post- operative complications which you experience.

11. Limitation of Liability

11.1  Since the Cosmetic Surgery Procedures and Logistical services are administered by third parties and are only brokered/coordinated via EI, then EI have no liability in contract or tort arising out of or in connection with any breach of the provisions of your contract/agreement with the Service Providers.

11.2  In no event shall EI be liable to the client for any special, consequential, indirect, collateral, incidental or punitive damages or lost profits or failure to realize expected savings or other commercial or economic loss of any kind, arising out of these terms and conditions or the provisions of your contract/agreement with the Service Providers.

12. Local standards and culture

12.1 We aim to provide a high standard of care and service. However, laws, standards, culture and attitudes are different in many countries from what you might reasonably expect at home. We are not responsible for standards of service, safety, hygiene and behavior provided by third parties which are not under our control during your stay and which may be lower than you are used to or which you expected.

13. Your behavior

13.1 If at any time it is our reasonable opinion that you are acting in a way which may cause accidents, injuries, discomfort or disturbance to any other guests, clients or our staff, we will reserve the right to terminate the Contract with immediate effect and youaccept in advance that in such circumstances any Fees or sums due to EI for out-of-pocket expenses or profits will be due from you in whole.

14. Complaints

14.1 We shall use best endeavors so that your stay is as comfortable as possible, and the Service Providers fulfil their contractual obligations to you. In the event that you are unhappy with any aspect, then you must immediately contact us via telephone, email or SMS so we may aid in resolving the issue.

15. Miscellaneous

15.1  In the event of a dispute between us, you undertake to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.

15.2  This Contract between you and The Service Provider and/or the Surgeon/Clinic to supply their services is strictly between you and them and EI are not party to these agreements.

15.3  If your medical records received by us, which with your express permission, may be passed on to The Surgeon/Clinic will be held in the strictest confidence in secured electronic files according to the latest Data Protection legislation and will not be disclosed to 3rd parties (except the Surgeon/Clinic who carry out the medical treatment) unless it is deemed to be necessary by the prevailing law or in case of a medical emergency.

15.4  Each of the clauses of these terms operates separately. If any clause (s) of this Contract becomes null and void for any reason whatsoever, the remaining clauses will remain in full force and effect.

15.5  If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking these terms and conditions, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date set by current ‘Statute of Limitation’. For example, if you miss a payment and we do not chase you, but we continue to provide your Package, the Surgeon/Clinic or third party providing the services may still require you to make the payment at a later date.

15.6  The Client must be at least 18 years old at the time of entering this agreement and undertaking the Clinical Procedure.

15.7  This Agreement shall be governed by and interpreted according to the Courts of England & Wales without giving effect to conflict of law principles thereof
